TERMS AND CONDITIONS

1. INTRODUCTION

Welcome to We Are One Wellness! By engaging with our health & fitness coaching services, you ("Client") agree to abide by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please refrain from using our services.

2. SERVICES PROVIDED

We Are One Wellness offers online health and fitness coaching services, including but not limited to:

  • Personalised fitness plans

  • Nutritional guidance and meal plans

  • Use of third-party platforms like Everfit for coaching and communication

3. CLIENT OBLIGATIONS

  • Provide accurate and up-to-date personal information, including health-related data, to enable effective coaching.

  • Follow the advice and instructions provided as part of the coaching service. We Are One Wellness is not responsible for outcomes resulting from non-adherence to provided plans.

  • Notify us of any changes in your health or fitness levels that may impact your ability to participate in the coaching program.

4. PAYMENT AND CANCELLATION POLICY

  • Weekly Payments: Weekly payments are due on the day you sign up for the service. Your weekly payment will renew on the same day each week, depending on the date you initially signed up.

  • Upfront Payments: If you choose to pay for services upfront, this payment covers the entire agreed-upon service period.

  • No Refunds: Except as required by Australian Consumer Law, no refunds will be provided if you choose to discontinue services before the end of the agreed period.

  • Considerations: In the event of unforeseen circumstances, such as serious injury or other unexpected situations, exceptions to the cancellation policy may be considered on a case-by-case basis at the discretion of We Are One Wellness.

  • Cancellation: If you wish to cancel due to the above considerations, you must provide at least two weeks' notice.

5. USE OF THIRD PARTY SERVICES

We Are One Wellness utilises Everfit, a third-party platform, to deliver coaching services. These platforms may collect and process your personal data independently. By engaging in our services, you consent to such data collection and processing. For more details, please refer to Everfit’s Terms of Service and Privacy Policy.

6. LIMITATION OF LIABILITY

  • We Are One Wellness provides advice and recommendations based on the information provided by the Client. However, results are not guaranteed as they depend on individual factors outside our control.

  • We Are One Wellness is not liable for injuries, damages, or losses incurred while participating in the coaching program, except where caused by gross negligence or wilful misconduct.

7. INTELLECTUAL PROPERTY

  • All content provided by We Are One Wellness, including fitness plans and nutritional advice, remains the intellectual property of We Are One Wellness.

  • Clients are granted a non-transferable licence to use the materials for personal purposes only.

  • Unauthorised sharing or reproduction of our materials is strictly prohibited

8. TERMINATION OF SERVICES

  • We Are One Wellness reserves the right to terminate the coaching agreement at any time if the Client breaches these Terms or fails to fulfil their obligations (e.g., payment or adherence to agreed schedules).

  • The Client may terminate the agreement by providing 30 days' written notice. However, payments made for coaching services are non-refundable, as coaching services are personalised and cannot be partially returned or reallocated.

  • Any outstanding fees must be settled upon termination.

9. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes shall be resolved exclusively in the courts of Australia.

11. UPDATES TO THESE TERMS

We Are One Wellness reserves the right to update these Terms from time to time. Clients will be notified of any material changes via email or updates on our website. Continued use of the services after changes constitutes acceptance of the updated Terms.
